Sacred Himalaya Limited is a Private Limited Company registered in Nepal under the laws of the Government of Nepal. Sacred Himalaya accepts reservations and bookings subject to the following Terms and Conditions.

Before confirming your trek or tour, please read these Terms and Conditions carefully.

Health and Fitness

All trips require a good level of health and physical fitness. It is the responsibility of each client to ensure that they are medically and physically fit to participate in the trek or tour they have chosen.

Travel Insurance

It is a mandatory condition of booking with Sacred Himalaya that all clients hold comprehensive travel insurance. This insurance must cover, at a minimum:

  • Trip cancellation
  • Accidents and illness
  • Emergency evacuation
  • Loss, theft, or damage to baggage and personal belongings

All emergency evacuation costs must be paid in cash in Nepal unless your insurance provider has agreed in advance to cover such expenses on your behalf. Please ensure that your insurance policy does not exclude alpinism or mountaineering activities. Rescue insurance is not available in Nepal.

Flights, Delays, and Itinerary Changes

The client agrees that Sacred Himalaya shall not be held responsible for delays or itinerary changes caused by acts, omissions, or circumstances beyond our control, including but not limited to domestic airlines or helicopter companies in Nepal. The client understands that such situations may arise and that it may not be possible to inform them of every potential issue in advance.

Client Conduct and Responsibility

We reserve the right to refuse or discontinue the participation of any client whose behavior causes inconvenience or annoyance to others or disrupts the smooth operation of a trip. Sacred Himalaya shall not be liable for any loss or damage to baggage or personal belongings, or for any consequential losses arising therefrom.

If a client is injured or becomes ill, all evacuation, hospital, medical, and repatriation costs are the client’s responsibility. No refund of the tour price will be made in such cases.

Clients are responsible for ensuring that they possess valid passports, visas, and all required equipment for their chosen tour. Sacred Himalaya does not accept responsibility for failure to obtain visas or for any documents left with us for this purpose.

Booking Confirmation and Payment

Your booking will be confirmed upon receipt of a deposit, which represents a specified percentage of the total trek or tour cost. The remaining balance must be paid prior to departure, as stated in your invoice.

If the balance is not paid by the specified deadline (unless previously agreed in writing), Sacred Himalaya reserves the right to cancel the booking.

Cancellation by the Client

Deposits are non-refundable. However, if cancellation is made before the final payment due date, the deposit may be transferred to another tour listed on our website, subject to availability.

If cancellation occurs after full payment has been made and within 10 weeks of departure, the following cancellation charges apply (calculated as a percentage of the total tour price, based on the date written notification is received):

  • 6 weeks before departure: 0% (deposit non-refundable)
  • 1 month before departure: 25%
  • 3 weeks before departure: 35%
  • 2 weeks before departure: 45%
  • 1 week before departure: 65%
  • 3 days before departure: 85%
  • On the day of departure or no-show: 100%

Cancellation by Sacred Himalaya

If Sacred Himalaya cancels a trek or tour, all payments made will be refunded in full. If cancellation is due to force majeure (including war, civil unrest, political instability, or natural disasters), reasonable expenses incurred will be deducted from the refund.

Refunds and compensation are limited to the amount paid to Sacred Himalaya. We are not responsible for any additional expenses incurred by the client. Tours will not be cancelled after final payment unless required by force majeure.

Price Change

Sacred Himalaya reserves the right to revise prices due to factors beyond our control, such as exchange rate fluctuations or government actions. If a price increase exceeds 10% of the total tour cost, clients may cancel and receive a full refund of all payments made, excluding insurance premiums.

No price increases will be applied within 30 days of tour commencement, except for bookings made within that period. We will make every effort to avoid price increases.

Accommodation

While we endeavor to meet room type and bedding preferences, these cannot be guaranteed.

Tour Leadership and Authority

The tour leader or local ground operator representing Sacred Himalaya has full authority during all treks and tours. By signing the booking form, you agree to abide by their decisions. Clients who engage in illegal activities or whose behavior endangers the safety or welfare of the group may be required to leave the tour without refund.

Complaints

Any complaints must be raised immediately with the tour leader, ground operator, or hotelier to allow prompt resolution. If unresolved, a written complaint must be submitted to Sacred Himalaya within 14 days of tour completion.

Travel Documents and Insurance

Clients are responsible for ensuring all required travel documents are valid and in order. Suitable travel insurance covering medical treatment, repatriation, and emergency evacuation is essential.

Website Accuracy

All information on this website is published in good faith and believed to be accurate at the time of publication. Any changes will be communicated as soon as possible.

Airlines and Carriers

The liability of any airline used is limited to the carriage of passengers and baggage in accordance with the airline’s conditions of carriage.

Legal Jurisdiction

These Terms and Conditions may only be waived in writing by a Director of Sacred Himalaya Limited. They are governed by and construed in accordance with the laws of Nepal.

By signing the booking form or proceeding with a reservation, you confirm your acceptance of these Terms and Conditions.

Wildlife Disclaimer

Sacred Himalaya, its ground operators, and representatives are not responsible for wildlife mentioned in itineraries that may not be seen during the trek or tour.

Customer Agreement

Limitations

This website is intended for personal and commercial use in accordance with these Terms and Conditions. You agree not to use this website for any illegal or prohibited purpose. You may not modify, copy, distribute, transmit, publish, display, license, create derivative works from, or sell any content, products, services, or software obtained from this website.

Your Warranties

You warrant that you are at least 18 years of age and legally authorized to enter into this agreement. You agree to be financially responsible for all use of this website and warrant that all information provided by you is accurate and truthful.

Contract Formation

A binding contract is formed once Sacred Himalaya accepts your reservation and provides written confirmation detailing the services offered.

Communications

Sacred Himalaya may communicate with clients via email or fax, according to customer preference. You agree that electronic or fax communications satisfy any legal requirement for written notice.
